Terms and conditions of use
All Terrain Vehicle Solutions (referred to as ATVS)
Terms and Conditions
Before submitting an order we recommend that you read and understand these policies.  When you submit an order you are agreeing to buy through ATVS and you may be bound by the terms described herein.

Prices
The final checkout price of items includes UK VAT where appropriate.   We will not charge for any purchases where a credit or debit card is used. 
Making a contract with us
When you place an order with us, either by telephone or online, you are making an offer to buy goods.  We will send you an email to confirm that we have received your order and a further email to confirm despatch of the said goods. 
All our transactions are covered by UK Law.
Payment
We accept payment by all major credit and debit cards. 
All online credit card transactions are processed through SagePay.  This is one of the UK’s largest payment gateways.  At ATVS we do not collect or have access to your credit card details.   All information is collected off-site through the SagePay website.  We reserve the right to refuse acceptance of payment details if we think they are being used fraudulently. 
Images
We make every effort
to ensure that the product images we use are accurate and up to date.  All product images are either owned by ATVS or are used with the permission of the originator and remain the copyright of the originator.  Unauthorised use of images owned by ATVS will be taken very seriously. 
Product Information
ATVS  make every effort to ensure that the product information we use is accurate and up to date.  
Delivery
Orders are always shipped at the first opportunity.  We aim to despatch all orders within 7 days.  If an item is not in stock it may be necessary to order that item from one of our suppliers before it can be despatched.  Therefore delivery may be delayed but we shall of course keep you informed of delivery.  The delivery costs are included within the item price for UK delivery only.  We are happy to provide a shipping quote to despatch items to the EU and outside the EU.   If you order products from our site for delivery outside the UK, they may be subject to Import Duties and Taxes which are levied when the delivery reaches the specified destination.  You will be responsible for payment of any such Import Duties and Taxes.  Please note that we have no control over these charges and cannot predict their amount.  Please contact your local Customs office for further information before placing your order. 
Please also note that you must comply with all applicable Laws and Regulations of the Country for which the products are destined.   
If we are unable to supply items you have ordered due to them being out of stock we will contact you.
We will do this to inform you the items are out of stock and reassure payment has not been taken.  We also do this to see if an alternative item would be suitable. 
ALL PARTS MUST BE CHECKED FOR ANY DAMAGE ON ARRIVAL AND PLEASE NOTIFY US IF THIS IS THE CASE. 
If the goods are lost or damaged in transit, please let us know immediately.
Returns
There are a multitude of reasons why you may wish to return or cancel your order, and we have a flexible returns policy to help make things more convenient. If you have any questions do not hesitate to contact us. 
Order Cancellations
You are free to cancel your order at any time and for any reason before it is despatched.  We do not take payment until despatch and so refunds are not normally necessary when an order is cancelled.  To cancel your order we need instructions from the person who placed the order either by email or phone. 
An order may not be cancelled after it has been despatched or while it is in transit, but must be treated as a return.  In this eventuality a refund will be provided when the goods are returned to us, within 30 days. 
Unwanted or unsuitable goods:
You are free to return unwanted goods in new & unused condition for up to 7 days after delivery. You will be entitled to your choice of an exchange or a full refund to the original payment card. The customer must meet the cost of returns postage for unwanted goods. We cannot accept responsibility for goods in returns transit, and so we recommend that you use registered post or an otherwise insured method.  
Incorrect goods dispatched: 
Occasionally the wrong item is sent to a customer.
You are free to return these goods in new and unused condition for 7 days after delivery.  You will be entitled to your choice of an exchange for the correct item or a full refund.  If you have been mischarged, we will correct the discrepancy.  ATVS will meet the cost of returns postage for defective goods. 
Order Returns
The vast majority of returns fall into one of two categories, each of which must be treated in a slightly different manner:
Defective goods
Broken goods under warranty
Defective goods:
You are free to return defective and misdescribed goods.  Please notify us as soon as possible.  You will be entitled to your choice of an exchange or a full refund to the original payment card.  ATVS will meet the cost of returns postage for defective goods.  Please note that the warranty given by both ATVS and the manufacturers of our products will only cover parts. Labour charges and other costs are not covered.
Broken goods under warranty:
You are free to return broken goods where a manufacturer warrants the goods supplied for the full warranty period after delivery. Your goods may be repaired or replaced under the manufacturers’ warranty , or you may be offered a refund depending on the decision of the manufacturer. We will send the goods to the manufacturer for assessment but the final decision lies with the manufacturer and you may have to wait for their tests to be completed. The customer must meet the cost of returns postage for warranty claims. We cannot accept responsibility for goods in returns transit, and so we recommend that you use registered post or an otherwise insured method. Please note that any warranty given by both ATVS and the manufacturers of our products will only cover parts. Labour charges and other costs are not covered.
NOTE: WE DO NOT OFFER WARRANTY ON USED OR SECOND HAND GOODS. 
IMPORTANT:
Exchanges will only be made where the same item is available in stock at the same price as the original. Items bought at special offer prices cannot be subsequently exchanged for identical items on sale at higher prices. If an item is not available a full refund may be the only option.
All goods must be returned in new & unused condition unless a warranty claim is being made. We reserve the right to refuse returned goods if necessary.
Where a full refund is the suitable course of action we have a statutory obligation to refund payment to the card used to pay originally within 7 days of the return of the goods. However we do not believe it is right to hold your money for longer than necessary and so a refund will be provided as soon as possible.
IMPORTANT
: Refunds are processed by credit & debit card companies less quickly than sales. A refund may take up to 10 days to appear on your statement after it has been authorised.
Exchnages Procedure
If you are returning goods for an exchange we would normally have to wait for the goods to arrive with us and inspect them before we can send out the replacement. However we recognise that sometimes an exchange must be made quickly and so we can send out a replacement immediately but please contact us to discuss this first.
Privacy
We are committed to protecting your privacy. We will only use the information that we collect about you lawfully (in accordance with the Data Protection Act 1998).
We collect information about you for two reasons: firstly, to process your order and secondly, to provide you with the best possible service.
We may email you regarding the specifics of your order but we will not email you any marketing material in the future unless you have given us your explicit consent.
We will not pass on your information to any third party.
The type of information we will collect about you includes:
Your name
Your address
Your phone number
Your email address
We will never collect sensitive information about you without your explicit consent.
The information we hold will be accurate and up to date. You can check the information that we hold about you by emailing us. If you find any inaccuracies we will delete or correct it promptly.
The personal information which we hold will be held securely in accordance with our internal security policy and all rules enabling us to be PCI DSS compliant.
We may use technology to track the patterns of behaviour of visitors to our site. This can include using a "cookie" which would be stored on your browser. You can usually modify your browser to prevent this happening. The information collected in this way can be used to identify you unless you modify your browser settings.
